Operating Under the Influence

Anyone can have their life turned upside down in an instant if they get pulled over for being suspected of operating under the influence (OUI) of alcohol. Even if a person has never been stopped by police before for any reason, one bad night can severely affect their life for years to come.

During his days as an Assistant District Attorney, Scott Niemisto prosecuted hundreds of OUI cases in Suffolk and Barnstable counties, giving him experience with almost every possible scenario. There are so many mistakes police can make during an OUI investigation. From unsupported or illegal motor vehicle stops to violations of constitutional rights, being represented by an attorney with extensive understanding of the law is essential in preparing an OUI defense.  Even in cases where clients have taken and failed the breath test, Scott knows what evidence to emphasize to give his clients the strongest chance of being found not guilty.

In addition to OUIs, Scott Niemisto defends clients in all types of motor vehicle charges including reckless driving, motor vehicle homicides, negligent operation and license suspensions.

If you or your child have been accused of a crime and are looking for representation from an attorney who operates with integrity, determination and expertise every step of the way, contact the

A Few Words from a Client

“In June of 2012, I was pulled over by the Massachusetts State Police and arrested for Operating Under the Influence of alcohol. I was represented by Mr. Scott Niemisto. During the duration of my case, he generously broke everything down from the purpose of a hearing to the right of having a judge or jury rule the case. He was more than happy to answer the countless questions I had for him. Although I am very pleased to have received a “not guilty” verdict, I am even more grateful to have had an attorney who demonstrated such professionalism, courtesy and thoughtfulness. I greatly respect Mr. Niemisto as a man and most importantly as a skilled lawyer.” – M.R. Devens, MA

“[Scott Niemisto] represented me in a DUI case in Orleans, Massachusetts. He did a good job at getting me in an alternate program rather than going to jail.” – Robert, MA
